WHAT AN ABSOLUTE HUGE MISJUSTICE and absolute JOKE the system made of this case.. Guess what? The Attacker could appeal his FIVE YEAR sentence on a re trial because they ‘decided to change the laws which allowed that appeal’ .. BUT when they CHANGED THEM BACK Jake’s family couldn’t appeal for a retrial like he did.. SO HE WALKED FREE..
A retrial Dallas Kahl got THAT NEVER SHOULD HAVE EVEN HAPPENED IN THE BLOODY FIRST PLACE.. So what if the law changed.. This COWARD was convicted on the law that was IN PLACE when he DID THIS.. That his PRIORS were submissible.. That’s all .. HE GOT A RETRIAL BECAUSE HIS PRIORS (YES PRIORS) HAD BEEN SUBMITTED.. He got a Retrial because the law changed for a SHORT TIME where Priors were now NOT admissible. And HE GOT his conviction over turned… Even though the retrial actually occurred AFTER the Laws were changed BACK.. Jake’s family were NOT ABLE TO APPEAL THEMSELVES. WTF am I missing here?? This boy had a life in the army serving his country ahead of him … He now requires full time care after one single UNPROVOKED punch by a man who walked free through a system that let Jake and his family down …
WHAT HAPPENED THAT NIGHT
- Jake was King hit on the 1.1.10
- Jake was not drinking or doing drugs
Jake drove down to the main street of Dorrigo, NSW. Jake, his girlfriend and Jake’s friend got out of the car and was talking to the friend that had txt’ed them to meet..
Jake forgot his smokes and got his mate to go and get them in Jake’s car…
Jake’s mate did a skid at the bottom of the street and then come and parked…
His mate got out of the car and a couple of young blokes approached him and had a few words smacked him in the mouth and Jake said “let’s go”…
Jake, his Girlfriend, and friend got in the car… As they drove off bottles were thrown and hit the car..
Jake reversed back, got out and asked the young blokes that hit his mate, “did they throw the bottles at his car?”..
They came up trying to rev Jake up and he wasn’t interested.. Jake said he didn’t want to fight….
Then out of nowhere Dallas Kahl come out … None of this was anything to do with him and he started in on Jake…
Jake told him to fuck off it had nothing to do with him & didn’t want to fight…
Dallas pushed and shoved Jake and Jake had his hands up in front of him saying “I don’t want to fight” and Dallas then King hit him once on the chin and knocked him out..
- Jake died when he hit the ground
- CPR was administered while they waiting for an ambulance
- Jake was transferred to Coffs Harbour hospital from Dorrigo
- The prognosis didn’t look good with the Dr speaking to his parents about turning off Jake’s life support..
- Jake was then transferred to Royal North Shore by plane and required immediate surgery on his brain
- Jake died again on the operating table with over 12 1/2 hrs of brain pressure..
- Jake has damage to left side of brain frontal, parietal, occipital damage and infarction (dead) on the brain
WHAT HAPPENED NEXT
In the First court case Dallas Kahl was found guilty in 2011. Two days later, a law changed giving Kahl a chance to appeal his conviction due to now not being allowed to submit priors in a case… Which regardless of that law changing back between the sentencing and the verdict and conviction his appeal under this changed law could still be heard… Which it was … And he walked free on that appeal … Kahl still had to go to sentencing in September 2011 where he was found guilty and given 5yrs 3 years non parole … But regardless of his conviction and the fact that the law changed back after he appealed he could not be recharged or convicted ……..
- Jake was then only entitled to Victims compensation of $10,000
Jake was also entitled to claim medical expenses which was not told to his family until after the payment was made… And case closed … Yet another pure lack of support for Jake and his family has endured…
- Jake has ongoing daily medical conditions including self harming
- he requires full time care for the rest of his life
Jake was only a week away from deployment with the Army … That is yet another shocking story of its own … Jake’s mum, still to this day, is struggling to access Jake’s Superannuation… No support and ongoing consistent red tape from the Government …. WHAT ELSE COULD POSSIBLY BE SAID ABOUT ALL OF THIS OTHER THAN – WHAT AN ABSOLUTE JOKE
